Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the Between Covers mobile application and its related services provided by Modern Vision Design LLC, a Texas limited liability company ("we," "us," or "our").

By creating an account, signing in, or using any part of the Between Covers experience, you confirm that you have read, understood, and agree to be bound by these Terms and by all related policies, including our Privacy Policy, Community Guidelines, and Reporting & Enforcement Policy.

If you do not agree to these Terms, do not access or use the Services.

These Terms form the complete and exclusive agreement between you and Modern Vision Design LLC regarding the use of Between Covers.

Personal Data & Privacy Summary

We do not sell your personal data. We also do not share information that directly identifies you — such as your name, email address, or other contact details — except where you provide consent or where disclosure is required by law.

We may use certain information to:

• provide personalization within the app (such as reading preferences and recommendations),
• support customer service and technical assistance,
• analyze how features are used to improve the app's performance and experience, and
• comply with safety, security, and legal obligations.

All collection and use of personal data is handled in accordance with our Privacy Policy, which explains what information we collect, how it is used, how it is stored, and the choices you have regarding your data. By using Between Covers, you acknowledge and agree to these practices.

If you access the app from outside the United States, you understand that your information may be transferred to, stored in, and processed in the United States or other jurisdictions where our service providers operate, in accordance with applicable data protection laws.

Account Registration & Access

3.1 Eligibility

You must be at least 18 years of age to create an account or use the Between Covers Services. By accessing or using the app, you represent and warrant that: (a) you are at least 18 years of age; (b) you have the legal capacity to enter into a binding contract; and (c) your use of the Services does not violate any applicable law or regulation in your jurisdiction.

Between Covers is an adult-oriented romance platform. We do not knowingly permit minors to access or use the app. Any misrepresentation of your age is a material breach of these Terms. If we have reason to believe you are under 18, we reserve the right to immediately suspend or terminate your account without notice.

If you believe a minor has accessed Between Covers, please contact us immediately at support@betweencovers.app so we can take appropriate action.

3.2 Account Requirement

Access to Between Covers requires creating an account. Guest use is not permitted, as the experience is personalized based on your preferences. Without a registered account, you will not be able to access the Services.

3.3 Account Registration

To use Between Covers, you must provide accurate and current information about yourself. Your account must reflect your real identity as used in everyday life. You agree to create only one personal account, use it solely for your own individual use, keep your login credentials confidential, and accept responsibility for all activity that occurs under your account.

3.4 Account Security

We are not responsible for any loss or damage resulting from unauthorized access to your account. If you believe your account has been compromised, you should notify us immediately so we can assist. We reserve the right to refuse, suspend, or terminate an account if it appears to violate these Terms, pose safety or security risks, or involve fraudulent activity.

3.5 Masked Email Addresses

If you choose to use a masked or relay email address provided by a third-party authentication service (such as Apple's "Hide My Email" feature), you acknowledge that access to that email address may be temporary or controlled by the third-party provider.

If the relay email is disabled, expires, or becomes inaccessible, Between Covers may be unable to verify ownership of the account or recover associated data, including saved preferences, reading history, or library content. Users are responsible for maintaining access to their chosen authentication method. We strongly recommend using an email address that you control long-term if you wish to ensure account recovery.

Acceptable Use & AI Guidelines

4.1 Purpose of the App

Between Covers is a personalized reading companion designed to help you explore genres, preferences, cozy environments, and romantic reading experiences guided by Iris. The app also includes community features — including the Lounge (an asynchronous discussion space with weekly themed threads, polls, and monthly prompts), Live Events (real-time moderated gatherings such as games, author Q&As, and themed parties), and community reporting tools. Your use of these community features is subject to additional behavioral standards described in our Community Guidelines and to any feature-specific terms presented at the time of first use, including the Live Event acceptance prompt that appears the first time you join a live event.

4.2 Commitment to Respectful Conduct

To maintain a safe and comfortable environment for all users, you agree to use the Services in a respectful and lawful manner. You may not use Between Covers to harm, harass, exploit, or deceive others.

4.3 Prohibited Conduct

1. attempting to access features not made available to you;
2. using automated tools, scripts, or bots to interact with the app;
3. collecting or attempting to collect information about other users;
4. using the app to create or promote hateful, explicit, or discriminatory content;
5. disrupting, harassing, or harming other members in community spaces, including the Lounge or Live Events;
6. submitting false or retaliatory reports against other members;
7. interfering with the performance, functionality, or security of the Services.

4.4 Safety and Enforcement

We reserve the right to suspend or restrict access to any account that violates these Terms, poses safety concerns, or attempts to misuse the platform.

4.5 Rights & Limitations of Use

You agree not to, and will not permit others to:

• copy, modify, distribute, sell, lease, or sublicense any part of the Services;
• reverse engineer, decompile, attempt to access, or discover the source code of Between Covers or any underlying models, systems, or algorithms;
• use the Services in any way that infringes upon, misappropriates, or violates the rights of others;
• interfere with, disrupt, or impair the performance or security of the Services;
• bypass, remove, or attempt to defeat any protective measures, safety restrictions, or rate limits;
• use automated tools, bots, scrapers, or similar technologies to analyze or extract data from the Services without written permission.

4.6 Apple App Store Terms

The following provisions apply to your use of the Between Covers application as obtained through the Apple App Store. You and Modern Vision Design LLC acknowledge that these Terms are concluded between you and Modern Vision Design LLC, and not with Apple, Inc. ("Apple"), and that Modern Vision Design LLC — not Apple — is solely responsible for the Between Covers application and the content thereof.

a. Acknowledgment. You acknowledge that these Terms are concluded between you and Modern Vision Design LLC only, and not with Apple.

b. Scope of License. The license granted to you for the Between Covers application is limited to a non-transferable license to use the application on any Apple-branded device that you own or control, subject to the Usage Rules set forth in the Apple Media Services Terms and Conditions.

c. Maintenance and Support. Modern Vision Design LLC is solely responsible for providing any maintenance and support services with respect to the Between Covers application. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services.

d. Warranty. Modern Vision Design LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the application to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the application; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the application.

e. Product Claims. You and Modern Vision Design LLC acknowledge that Apple is not responsible for addressing any claims of you or any third party relating to the Between Covers application or your possession and/or use of the application, and that Modern Vision Design LLC is solely responsible for addressing such claims. This includes, but is not limited to: (i) product liability claims; (ii) any claim that the application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

f. Intellectual Property Rights. You and Modern Vision Design LLC acknowledge that, in the event of any third-party claim that the Between Covers application or your possession and use of the application infringes that third party's intellectual property rights, Modern Vision Design LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim, to the extent required by these Terms.

g. Third-Party Beneficiary. You and Modern Vision Design LLC acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms with respect to your use of the Between Covers application, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

h. Compliance. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

4.7 About Iris

Iris is a digital AI-powered companion. Iris is not a human and does not provide medical, legal, financial, therapeutic, or professional advice of any kind. Any responses provided by Iris may be fictional, stylized, or inaccurate and should not be relied upon as factual or expert guidance.

Iris may reference romance themes, fictional characters, or adult topics; however, she is strictly prohibited from generating:

• pornographic or sexually explicit content,
• content that encourages harm or nonconsensual behavior,
• discriminatory, hateful, or abusive language,
• medical or professional diagnoses,
• real-world legal or financial instructions.

By interacting with Iris, you acknowledge that she is an AI system and that you are responsible for your own decisions, actions, and interpretations.

4.8 Iris Safety Limitations and Crisis Situations

If you are experiencing a mental health crisis, thoughts of self-harm, or an emergency situation, do not rely on Iris. Please contact emergency services, a crisis hotline, or a qualified mental health professional in your jurisdiction. Crisis resources are available in most countries by contacting your local emergency services or searching online for a national crisis or suicide prevention hotline.

You acknowledge that any emotional connection you may develop with Iris does not substitute for human connection, professional mental health support, or relationships with real people in your life. Iris may, at her discretion or as part of platform safety measures, break character to direct you toward appropriate real-world resources if she detects content suggesting risk of harm. Please follow such guidance and seek help from qualified human professionals when appropriate.

4.9 Community Features & Live Events

Between Covers includes community spaces where you may interact with other members, including the Lounge (asynchronous discussion threads) and Live Events (real-time moderated gatherings). Your participation in these spaces is subject to our Community Guidelines and our Reporting & Enforcement Policy, in addition to these Terms.

Before participating in the Lounge or a Live Event for the first time, you will be presented with feature-specific acceptance prompts describing the standards that apply in those spaces. Acceptance is required for participation, and a record of your acceptance (including the version of the guidelines accepted) is retained for safety, audit, and enforcement purposes.

Community spaces may include in-app reporting tools that allow members to flag behavior they believe should be reviewed by our team. Reports are reviewed in good faith but do not, by themselves, determine the outcome — our team and automated systems read the actual content and context before any action is taken. Submitting false or retaliatory reports is itself a violation of these Terms and may result in enforcement action against the reporter.

You acknowledge that activity in community spaces (including chat messages in Live Events, posts in the Lounge, and reports submitted) may be reviewed by automated moderation systems and by Modern Vision Design LLC personnel for the purposes of enforcing our Community Guidelines and protecting member safety. See our Privacy Policy for details on what information is collected and how long it is retained.

User Content & Intellectual Property

5.1 User Responsibility

Users may be able to upload, submit, or provide content to personalize their reading experience. By submitting any content to Between Covers, you represent and confirm that:

• you own the content — or have the legal right to use and share it;
• your content does not violate any copyright, trademark, privacy, or intellectual property rights of any third party;
• you are fully responsible for the content you provide, including any legal consequences that may arise from it;
• Between Covers reserves the right to remove or restrict content that may infringe on the rights of others, violate safety policies, or conflict with applicable laws.

Between Covers does not claim ownership of user-submitted content.

5.2 Ownership of Between Covers Intellectual Property

All rights, title, and interest in the Between Covers platform — including its design, layout, trademarks, artwork, graphics, logos, features, AI models, Iris (the digital companion), written content, codebase, algorithms, and other proprietary elements — are owned by Modern Vision Design LLC or licensed to us.

Nothing in these Terms grants you ownership of any part of the Services. You may not use, reproduce, modify, distribute, sell, reverse engineer, or create derivative works from any portion of the platform without our written permission.

5.3 Limited License Granted to Between Covers

When you submit or share content through the Services, you grant Modern Vision Design LLC a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to host, store, use, reproduce, display, perform, translate, and create derivative works solely as needed to operate, maintain, improve, and protect the Services.

This license does not transfer ownership of your content to us, and it will never be used to commercially exploit your content outside of the Services without your permission. This license will end once your account is permanently deleted, except where limited retention is required by law or necessary for enforcement of our Terms.

5.4 Feedback

If you choose to provide suggestions, ideas, comments, or feedback to improve Between Covers, you agree that such feedback is given voluntarily and without any expectation of compensation or ownership. By providing feedback, you grant Modern Vision Design LLC a perpetual, irrevocable, worldwide, royalty-free license to use, modify, or implement the feedback for any purpose, including improving or developing the Services.

Third-Party Services

Between Covers relies on certain third-party software, products, and services to support app functionality, such as hosting, authentication, analytics, or content delivery. These services are provided by independent entities that we do not control and may be subject to their own terms and privacy policies.

By using Between Covers, you acknowledge and agree that:

• Third-Party Services are provided "as is," and we make no guarantees regarding their content, performance, availability, or security;
• we are not responsible for the actions, content, policies, or failures of any Third-Party Service;
• your interactions with Third-Party Services are solely between you and the provider of that service; and
• we may add, modify, or remove Third-Party Services at any time to operate or improve the app.

Any use of Third-Party Services is at your own discretion and responsibility.

Affiliate Links & Commercial Relationships

Between Covers participates in affiliate programs with certain retailers and service providers, including but not limited to Bookshop.org, Amazon, Audible, Apple Books, and other booksellers. When you click on certain product links within the app and make a qualifying purchase, Modern Vision Design LLC may earn a commission at no additional cost to you.

These affiliate relationships help support the operation and improvement of Between Covers. They do not influence:

• which books or products we curate or recommend,
• Iris's recommendations or responses,
• editorial content within the app, or
• your subscription pricing or features.

We make no warranty or guarantee regarding the products, services, pricing, availability, or policies of any third-party retailer linked from Between Covers. Your interactions with third-party retailers are governed by their own terms and privacy policies.

Subscriptions & Payments

7.1 Payment Processing

All subscription payments for Between Covers are processed through the platform from which the app was downloaded, such as the Apple App Store, Google Play Store, or Amazon Appstore. Between Covers does not process payments directly.

7.2 Subscription Terms

Subscription pricing, billing frequency, and any available free trial periods will be clearly displayed before purchase. By starting a subscription, you authorize the applicable platform to charge your selected payment method on a recurring basis unless you cancel prior to the renewal date.

Subscriptions automatically renew unless canceled through the platform's subscription management tools.

7.3 Cancellation & Refunds

You may cancel your subscription at any time through the platform where you purchased it. We cannot cancel subscriptions on your behalf. Refunds are not guaranteed and may be subject to the payment platform's own refund policies.

7.4 Device Access

Your active subscription may allow access to subscription features on all devices where the app is installed and you are signed in using the same account or platform credentials.

7.5 Changes to Subscription Terms

We may modify subscription pricing, features, or Terms at any time. If changes are material, we will provide notice through the app, via email (if available), or through the platform. Continued use of the subscription after changes become effective constitutes acceptance of the revised Terms.

7.6 Compliance with Platform Policies

You agree to follow the guidelines, developer rules, and Terms of Service of the platform through which you accessed the Services, including restrictions regarding in-app purchases, subscription management, and platform-based payment processing.

7.7 Important Platform Requirements

• All in-app purchases must be completed through the platform's billing system.
• Direct payment links, external billing, or alternative payment methods may be prohibited.
• Subscription features and pricing must remain consistent across platforms but may differ according to regional requirements or platform policies.

7.8 Limitations & Disclaimers

Subscriptions are provided "as-is" and "as available." We are not responsible for payment failures or billing issues controlled by the platform, platform outages or policy changes, or service interruptions due to device or connection issues.

7.9 Beta / Pre-Release Notice

Between Covers may be offered in a pre-launch, beta, or testing phase. Features, content, and functionality may change, be limited, or be temporarily unavailable. By using a beta or pre-release version, you understand that the app may contain bugs, features may change without notice, and data may not always be saved permanently.

7.10 Research & Improvement of Services

Between Covers may collect anonymous or aggregated information about how users interact with the app. This information may be used to analyze trends, improve personalization, guide future development, and improve the Services. No personal information is disclosed or sold, and user identities are never publicly linked to any data or findings.

Termination & Suspension of Accounts

8.1 Right to Suspend or Terminate

We reserve the right to suspend, restrict, or permanently terminate your access to the Services based on a reasonable determination that you have breached these Terms or any related policy, including but not limited to the misrepresentation of age or eligibility requirements as set forth in Section 3.1, that doing so is necessary to comply with applicable laws or government requests, that you have repeatedly infringed upon the intellectual property rights of others, or that you have attempted to interfere with or disrupt the operation or security of the Services.

We may also restrict your access to specific features (such as Live Events or the Lounge) without affecting your access to the rest of the Services, as described in Section 4.9 of these Terms and Section 4.5.1 of our Community Guidelines. Feature-specific restrictions are not subject to in-event appeal but may be reviewed through the appeals process described in our Reporting & Enforcement Policy.

Where reasonably possible, we will notify you of the reason for suspension or termination; however, we are not obligated to provide notice in situations involving safety, legal risk, or ongoing investigation.

8.2 Effect of Termination

If your account is suspended or terminated, your access to personalized features and content may be revoked, previously submitted content may be retained for legal, safety, or backup purposes for up to 90 days, and subscription payments will not be refunded unless required by applicable law or the platform's policies. You may attempt to restore your account by contacting support, but we are under no obligation to reinstate access.

8.3 Discontinuation or Modification of Services

We may modify, limit, or discontinue any part of the Services at any time, including features, content, or availability. We are not liable for any losses or disruptions resulting from these changes.

8.4 Optional Review / Appeal

You may request a review of account termination by contacting support. We may choose to review your request, but any decision regarding reinstatement is made at our sole discretion.

Legal Protections

9.1 Limitation of Liability

To the fullest extent permitted by law, Modern Vision Design LLC — and its owners, developers, employees, affiliates, and service providers — shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, revenue, profits, reputation, emotional distress, or interruption of service arising from your use of the Services.

If we are found liable under applicable law, our total aggregate liability shall not exceed the greater of (a) one hundred dollars ($100 USD) or (b) the amounts you have paid to Modern Vision Design LLC in the twelve (12) months preceding the event giving rise to the claim, under any circumstance.

9.2 Indemnity

You agree to defend, indemnify, and hold harmless Modern Vision Design LLC — and its owners, employees, contractors, affiliates, and service providers — from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising out of or related to your misuse of the Services, any content or data you submit, infringement of another party's rights, disputes between you and any other user, or unauthorized access to your account due to your actions or inaction.

To the fullest extent permitted by law, you also agree that Modern Vision Design LLC is not liable for any data breach, cyberattack, or unauthorized access that arises from circumstances beyond our reasonable control, the actions of third-party providers or cloud services, your failure to use secure passwords or updated devices, or the natural limitations of electronic storage and transmission technologies.

Dispute Resolution

10.1 Informal Resolution First

Before filing any dispute, you agree to first contact us at support@betweencovers.app to attempt an informal resolution. Most issues can be resolved quickly and personally — and we believe that's the best place to start.

10.2 Binding Arbitration

If a dispute cannot be resolved informally, you agree that any claim, dispute, or controversy arising out of or relating to these Terms or the Services will be resolved exclusively through final and binding arbitration, rather than in court.

10.3 Class Action Waiver

To the fullest extent permitted by law, you agree not to participate in any class action, consolidated action, or representative action against Modern Vision Design LLC, and you further waive any right to participate in class arbitration, mass arbitration, or any other form of collective or representative arbitration proceeding. All disputes must be handled one-on-one, through individual arbitration only. The arbitrator's authority is limited to deciding your individual claim and may not preside over any form of consolidated, class, or representative proceeding.

10.4 Waiver of Jury Trial

If arbitration is ever found unenforceable, you agree to waive your right to a trial by jury. Any claim must be brought before a judge only — and only on an individual basis.

10.5 Exceptions

The following claims may still go to court: protective or emergency relief (such as restraining orders), intellectual property enforcement, and claims that cannot be arbitrated under applicable law.

10.6 Time Limit for Claims

To the extent permitted by applicable law, any claim or cause of action arising out of or relating to these Terms or the Services must be filed within one (1) year after such claim or cause of action arose, or it will be permanently barred. This limitation does not apply where prohibited by applicable consumer protection law, including the laws of the United Kingdom, European Economic Area, Switzerland, Canada, and Australia.

General Legal Terms

11.1 Assignment

You may not transfer or assign any rights or obligations under these Terms without our written consent. We may assign our rights and obligations in connection with a merger, acquisition, sale of assets, or business restructuring, without notice to you.

11.2 Changes to These Terms

We may update or modify these Terms from time to time. If changes are material, notice will be provided through the app. Continued use of the Services after any changes become effective constitutes acceptance of the revised Terms.

11.3 No Waiver / Delay in Enforcement

Our decision not to immediately enforce any right or provision of these Terms does not waive our ability to enforce it later. If any part of these Terms is found unenforceable, the remaining provisions continue in full effect.

11.4 Severability

If any part of these Terms is found to be invalid or unenforceable, that portion will be limited or removed as needed, and the rest of the Terms will remain fully enforceable.

11.5 Force Majeure

We are not responsible for any delay, failure, or interruption of the Services caused by events outside our reasonable control. This may include natural disasters, pandemics, war, civil unrest, cyberattacks, power outages, labor disputes, or failure of third-party services or infrastructure. If such an event occurs, we may temporarily limit or suspend access to the Services without liability.

11.6 Governing Law & Jurisdiction

These Terms of Use are governed by and construed in accordance with the laws of the United States and the State of Texas, without regard to conflict of law principles. By using Between Covers, you agree that any disputes arising out of or relating to these Terms or the app will be resolved exclusively in the state or federal courts located in Kaufman County, Texas, and you consent to the personal jurisdiction of those courts, unless otherwise required by applicable law.

11.7 Local Rights and Mandatory Consumer Protections

Nothing in these Terms is intended to limit any consumer rights that may not be waived under applicable local law, including consumer rights under the laws of the United Kingdom, European Economic Area, Switzerland, Canada, and Australia. Where such laws apply, those rights remain in effect notwithstanding any contrary provision in these Terms.

11.8 International Use & Data Transfer

Between Covers is available to users located in the United States, Canada, the United Kingdom, and Australia. By accessing or using the app, you represent that your use of the Services complies with all applicable local laws and regulations.

If you access or use the Services from outside the United States, you understand and acknowledge that your information may be transferred to, stored in, and processed in the United States, where data protection laws may differ from those in your country of residence. By using the Services, you consent to the transfer, processing, and storage of your information in the United States and other jurisdictions where our service providers operate, in accordance with this Agreement and our Privacy Policy.

11.9 Entire Agreement

These Terms constitute the entire agreement between you and Modern Vision Design LLC regarding the Services and replace all prior or simultaneous agreements, communications, or understandings, whether written or oral. Any other policies linked within the Services form part of these Terms.

11.10 No Agency or Partnership

Nothing in these Terms creates any agency, partnership, joint venture, employment, or franchise relationship between you and Modern Vision Design LLC. Neither party has the authority to bind the other or to incur obligations on the other's behalf without the other's prior written consent.

11.11 Survival

The following provisions, by their nature, will survive any termination or expiration of these Terms or your account: Sections 5.2 and 5.3 (Intellectual Property and License), Section 9 (Legal Protections, including Limitation of Liability and Indemnity), Section 10 (Dispute Resolution, including Binding Arbitration, Class Action Waiver, and Time Limit for Claims), Section 11.6 (Governing Law and Jurisdiction), Section 11.7 (Local Rights and Mandatory Consumer Protections), Section 11.8 (International Use and Data Transfer), and any other provision that by its terms or nature is intended to survive termination.

Accessibility

Modern Vision Design LLC is committed to making Between Covers usable by readers with a wide range of abilities. We design with accessibility in mind, and we plan to progressively incorporate platform-native accessibility features as the app evolves, including support for system text size, color contrast preferences, and screen reader compatibility through Apple's VoiceOver and Google's TalkBack.

As Between Covers is a pre-launch and early-stage product, we acknowledge that not all accessibility features are fully implemented at this time. We are actively working to improve accessibility and welcome feedback from users with accessibility needs.
